Estate Planning

Estate planning is the process by which an individual or family arranges the transfer of assets in anticipation of death.  An Estate Plan aims to preserve the maximum amount of wealth possible for the intended beneficiaries and flexibility for the individual prior to death. 


Wills

The Will Act provides that a Will has to comply with certain formalities in order to be valid.

A Will is a document that appoints an Executor and contains, among other aspects,  your direct wishes for your assets, as well as the care of your dependants.  Failure to prepare a Will typically leaves decisions about your estate in the hands of judges or state officials and may also cause family strife.



Deceased Estates

When a person dies, his estate has to be wound up.  Such an estate must then be administered and distributed in terms of the deceased's will or, if there is no valid will, in terms of the Intestate Succession Act (Act 81 of 1987)
